The Division of Student Affairs, Department of Human Resources, and Environmental Safety & Health seek to revise POL04.20.05, Illegal Drugs, (“Policy”) in order to:
---Reflect the UNC Board of Governors’ changes and amendments to the UNC Illegal Drugs Policy, 1300.1, adopted on June 15, 2012;
---Revise the penalties for a violation of the Policy to now allow for a range of penalties to be enforced depending on the nature and the seriousness of the offense, rather than the previous prescribed minimum penalties that the University must enforce for certain offenses;
---Update the Policy to reflect current University practices for drug education and enforcement;
---Reformat the Policy to divide the section on Penalties and Enforcement for violations of the Policy to reflect those penalties and sanctions applicable to students and those that are applicable to employees only;
---Bring the Policy into compliance with the Drug-Free Schools and Communities Act Amendments of 1989, and sections 120(a)(1) and (2) of Title I of the Higher Education Act of 1965, as Amended, which require the University to certify to the Secretary of Education that it has adopted and implemented a program to prevent the use of illicit drugs by students and employees, including an annual distribution of specified drug abuse prevention information to each student and employee, and a biennial review of the effectiveness of its educational programs regarding illegal drugs and consistency of sanction enforcement. |
