1. SCOPE AND STATEMENT OF PURPOSE

1.1 This Regulation governs all buildings that are owned by the State and allocated to and used or occupied by North Carolina State University (“university”), State-owned buildings allocated to the university and leased to third parties, and space in buildings owned by third parties and leased to and occupied by the university (collectively, “university buildings”).  This regulation also governs the grounds and walkways of such properties.

1.2 This Regulation is adopted in accordance with North Carolina law for the purposes of improving public health.

2. SMOKING RESTRICTIONS

2.1 Buildings

Smoking is prohibited inside university buildings, except those personal rooms in residential facilities expressly designated as smoking permitted. Smoking is prohibited in all parts of university buildings, including personal rooms of residential facilities.

2.2 Grounds & Walkways

Smoking is prohibited within 25 linear feet of all university buildings.  Smoking may be prohibited in other outdoor spaces (beyond 25 feet) for safety or health reasons.

2.3 Vehicles

Smoking is prohibited inside State vehicles. The individual or the individual’s designee in charge of assigning the vehicle shall place one or more signs in conspicuous areas of the vehicle.  The signs shall state that “smoking is prohibited” and may include the international “No Smoking” symbol (a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it).  If the vehicle is used for undercover law enforcement operations, a sign is not required to be placed in the vehicle as provided in this subsection.

2.4 Exceptions

2.4.1 Smoking is permitted inside university buildings that are used for medical or scientific research to the extent that smoking is an integral part of the research.  Smoking permitted under this subsection shall be confined to the area where the research is being conducted.

2.4.2 A dean or vice chancellor may designate an outdoor space as an authorized smoking location within 25 feet of a building for which s/he has administrative authority, as long as the location is at least 25 feet from all public entrances and HVAC intakes.

3. IMPLEMENTATION

3.1 Facilities shall be responsible for the design, installation, and maintenance of signage to indicate “smoking is prohibited” at appropriate building locations, and signage to indicate areas within 25 feet of university buildings that have been approved by an appropriate dean or vice chancellor as designated smoking places. The Facilities Division will provide appropriate receptacles for smoking waste in designated areas.

4. DEFINITIONS

4.1  The terms “smoking, smoke, or smokes” shall be defined to include “the use or possession of a lighted cigarette, lighted cigar, lighted pipe, or any other lighted tobacco product.  The terms shall also include the use or possession of an electronic cigarette, personal vaporizer, or electronic nicotine delivery system that is a battery-powered vaporizer  that simulates tobacco smoking by producing an aerosol that resembles smoke.
