REG 01.20.01 – Delegations of Authority to Appoint and to Determine Compensation for Employees Exempt from the State Human Resources Act (EHRA)

1. Introduction

1.1 This regulation sets forth the Chancellor’s authority for various EHRA personnel appointments and related decisions and certain delegations from the Chancellor to the Provost, a Vice Chancellor, a Dean, the Director of Libraries, and the Director of Athletics. No appointment, reappointment, or salary increase is effective unless it is approved by the administrative officer or body with final authority for the personnel action.

1.1.1 Authority not delegated in this administrative regulation remains with the Chancellor.

1.1.2 Delegations of authority to administrative officers may not be sub-delegated.

1.2 EHRA personnel pertinent to this regulation are faculty, EHRA professionals, and SAAO Tier-II employees.

2.Chancellor’s authority for EHRA personnel actions

2.1 Pursuant to The University of North Carolina Code and policies of the Board of Trustees, the Chancellor has final approval authority for the following EHRA personnel actions:

2.1.1 Appointment of a tenured faculty member to a professorship of distinction;

2.1.2 Appointment or reappointment to a tenure-track faculty position;

2.1.3 Appointment or reappointment of faculty member holding a special faculty appointment;

2.1.4 Appointment as an academic department head;

2.1.5 Appointment or reappointment to an SAAO Tier-II position (except Director of Athletics);

2.1.6 Appointment or reappointment to an EHRA professional position;

2.1.7 Promotion of a tenured or tenure-track faculty member;

2.1.8 Promotion of a faculty member holding a special faculty appointment;

2.1.9 Promotion of an EHRA professional;

2.1.10 Salary increases that are less than 15% of the previous June 30th salary for all EHRA personnel except Vice Chancellors and the Provost.

2.1.11 Temporary supplements/stipends for all EHRA personnel except Vice Chancellors and the Provost.

2.2 All other EHRA personnel appointments, reappointments and promotions are recommendations by the Chancellor to the Board of Trustees.

2.3 The Chancellor may delegate his or her authority to other administrative officers.

3.Delegations of Authority to Appoint, Reappoint or Promote EHRA Personnel

The Chancellor delegates to the Provost, the Vice Chancellors, the Deans, the Director of Libraries, and the Director of Athletics final approval authority for the following personnel actions:

3.1 Provost

3.1.1 Appointment or reappointment to an SAAO Tier-II position in his/her unit;

3.1.2 Appointment or reappointment to an EHRA professional position in his/her unit;

3.1.3 Promotion of an EHRA professional in his/her unit.

3.2 Vice Chancellors and Director of Athletics

3.2.1 Appointment or reappointment of a faculty member holding a special faculty appointment in his/her unit;

3.2.2 Appointment or reappointment to an SAAO Tier-II position in his/her unit;

3.2.3 Appointment or reappointment to an EHRA professional position in his/her unit;

3.2.4 Promotion of an EHRA professional in his/her unit.

3.3 Deans and Director of Libraries

3.3.1 Appointment, reappointment to a tenure-track faculty position;

3.3.2 Appointment as an academic department head;

3.3.3 Appointment or reappointment of a faculty member holding a special faculty appointment in his/her unit;

3.3.4 Appointment or reappointment to an SAAO Tier-II position in his/her unit;

3.3.5 Appointment or reappointment to an EHRA professional position in his/her unit;

3.3.6 Promotion of an EHRA professional in his/her unit.

3.3.7 Appointment of a tenured faculty member to a Named Professorship not endowed by the Board of Governors.

4. Delegations of Authority to Approve Compensation for EHRA Personnel

4.1 Pursuant to The University of North Carolina Code and policies of the Board of Trustees, the Chancellor has the final approval authority for initial compensation and salary increases that are less than 15% of the preceding June 30th salary for all EHRA personnel except Vice Chancellors and the Provost.

4.2 The Chancellor delegates to the Provost, the Vice Chancellors, the Deans, the Director of Libraries, and the Director of Athletics final approval authority for initial compensation and salary increases of less than 15% of the previous June 30th salary for the following EHRA personnel. For purposes of this delegation, the Dean shall be considered the immediate supervisor of a faculty member. For joint appointments to administrative positions where the individual also holds tenure, the official with delegated authority for the primary appointment shall have the authority to approve the compensation for the joint appointment. The Chancellor further delegates to the Provost, the Vice Chancellors, the Deans, the Director of Libraries, and the Director of Athletics the final approval authority for temporary stipends/supplements for the following EHRA personnel.

4.2.1 Provost

a. Tenured faculty;

b. Tenure-track faculty;

c. SAAO Tier-II in his/her unit;

d. EHRA professionals in his/her unit.

4.2.2 Vice Chancellors and Director of Athletics

a. SAAO Tier-II in his/her unit;

b. EHRA professionals in his/her unit.

c. Faculty members holding a special faculty appointment in his/her unit.

4.2.3 Deans and Director of Libraries

a. Faculty members holding a special faculty appointment in his/her unit;

b. EHRA professionals in his/her unit.

c. SAAO Tier-II in his/her unit

5. Delegation of Authority to Discontinue At Will EHRA Professionals

The Chancellor designates the Provost as the Chancellor’s designee for purposes of decisions and notifications related to the discontinuance of at will EHRA Professionals.

6. Delegation of Authority to Notify Tenure Track Faculty of Non-Reappointment

The Chancellor designates the Provost as the Chancellor’s designee for purposes of providing notification of non-reappointment of regular faculty members.

7. Notification to the Employee of EHRA Personnel Actions

Written notification of personnel actions which require approval of the Board of Trustees and/or Board of Governors will be sent by the Chancellor. Written notifications of other personnel actions will be sent to employees by the administrative officer having the final approval authority for the personnel action.
